Terms and Conditions

The aim of the Terms and Conditions below is to set out the rights and responsibilities of us (the Supplier) and you (the Customer). By placing an order with us you are agreeing to be bound by these Terms and Conditions. From time to time there may be amendments to these Terms and Conditions. These amendments will be displayed on our website.

Who am I contracting with?

Charlton Garden Company (the Supplier) is the trading name of P.B. Stevenson

Buying Products

Products will usually be purchased online. However Customers may, if they prefer, place orders in writing with payment by cheque. Orders will not be dispatched until the Customer's cheque has cleared. The Terms and Conditions remain the same for orders by post as they are for orders via the website. By posting your order or clicking on the "proceed" button, when ordering online, you will be deemed to have accepted the Terms and Conditions.

Prices

All prices shown are inclusive of VAT, where applicable, at the current rate. Orders over £50 have free standard delivery. Please see the "Delivery" section of these terms to confirm that your address falls within the Standard Delivery area.

Whilst every effort is made to ensure that the price is correct on the Supplier's website, should a pricing error occur we will contact you at our earliest opportunity. You will then be given the option to proceed with your order at the correct price or cancel the order.

Time to time the prices of goods supplied may be altered. The price the Customer will pay is the price current at the time of order.

Payment

Payment is usually by credit or debit card via the Supplier's website. Should a customer prefer to pay for his or her order by cheque this can be done by posting the order and cheque to Customer Services. The order will not be dispatched until the cheque has cleared. The Supplier reserves the right to refuse orders.

The order must be placed in the name of the cardholder or cheque account holder and their home address must be provided. The information supplied by the Customer must be correct and they must have credit/debit facilities sufficient to cover the cost of the order.

Confirmation

A receipt of order should be sent to the Customer's e mail address soon after the order has been submitted. Once payment has been received a confirmation of order will then be sent. This confirmation should be received within two working days of receipt of order. In the event of this not happening please contact Customer Services.

Please note that the Supplier reserves the right to refuse orders.

Availability

We pride ourselves on our close working relationship with our suppliers. However from time to time stock may become unavailable. Should this be the case with your order we will contact you and discuss the way you would like to proceed. This may mean accepting a slightly longer delivery time, accepting an alternative product or canceling the order.

Delivery

There is no delivery charge for orders over £50, for Standard Delivery addresses. Standard Delivery is to mainland England, Wales and Scotland excluding the following post codes:

AB37-38-56, IV-37, IV25, IV63, KW1-14, PH15-49, PA21-39, PO30-41, IV21-56, KW5-17, FK19-21, PA20-76, PH30-50, HS1-9, KA27-28, ZE1-3.

Flower deliveries to UK addresses will be delivered the next working day unless a date is specified in the 'special deliveries instructions box'. Similarly flower deliveries to non-UK addresses will be delivered within 2 working days unless specified otherwise. Flower prices will include standard delivery. When orders are processed by using the Teleflower service a relay charge of £3.95 will be deducted from the order value. There may be additional charges for overseas deliveries which we will notify you of before processing your order.

For pet and gift orders (other than flowers) of £50 or less there is a charge of £4.99 for deliveries within 5 working days of receipt of order.

For pet and gifts (other than flowers) deliveries within 2 working days of order there is a charge of £7.99. Gift vouchers have free standard delivery.

We will make all reasonable efforts to supply Customers who fall outside the Standard Delivery area (including international orders). However there may be an additional delivery charge and/or a delay in delivery. Please contact Customer Services so that we can discuss your requirements further. No additional charge will be incurred without the Customer's prior consent.

The confirmation of order will give an estimate for the delivery date of your goods. The Customer will recognise that third party couriers are used and the actual delivery time is often beyond our control.

The delivery process can often be eased by clear information from the Customer. Please use the "Notes" section when ordering to give any additional information that will ease delivery.

Receipt of Goods

The Customer must check the goods when they are delivered. Should any packaging look damaged please ensure the goods are sound and if you are not satisfied refuse delivery of the affected item and sign the delivery/consignment note accordingly. The Customer must check that the correct number of packages have been received. Any shortages or problems with the delivery should be notified to Customer Services within 24 hours of the delivery.

Cancellation

We pride ourselves on customer service. However, on occasions, things may go wrong. We will make every effort to resolve your problem but should you wish to cancel your order please contact Customer Services.

All cancellations will need to be made in writing (this can include via e mail). You may cancel your order within 7 days of date of order for any reason. Please check the status of your order prior to cancellation as additional charges may be incurred if goods have already been dispatched.

Where goods are delivered in error, are faulty or not in satisfactory condition, no charge will be made for the collection of the goods. The Customer must make best endeavors to maintain the goods in the condition received and with original packaging. Flat pack goods must be returned as flat packs.

If the goods have been dispatched at the time of cancellation you may be charged for the cost of collection if the reason for the cancellation is other than the product is faulty or damaged or delivered in error.

Returns

You may return the goods within 7 days of delivery. You must notify us in writing (including e mail) if you wish to return goods giving a reason for the return.

If the goods were delivered in error, faulty or of unsatisfactory quality there will be no charge for collection of the goods. We may replace the item or affected parts where applicable or arrange a refund.

If the goods are returned for reasons other than error, fault or unsatisfactory condition the Customer must pay the cost of collection which will be deducted from your refund.

What ever the reason for the Return, the goods must be returned in the same condition they were delivered and with original boxes etc. Products must be packaged sufficiently well to avoid damage or loss in transit. If any such damage or loss occurs as a result of insufficient packaging by the customer the value of the Refund may be reduced.

Refunds

All Refunds will be processed within 30 days.
